Department of Labor Targeting Home Care Agencies
Caregivers, is your current agency misclassifying you as an independent contractor rather than a W2 employee? In a recent announcement, the US Department of Labor is targeting home care agencies that misclassify their caregivers as independent contractors. This misclassification deprives you of your federal labor protections, including your right to be paid your full, legally earned wages, including overtime.
Does your current agency:
- Pay 150% for overtime hours?
- Offer you health benefits?
- Cover you with workers compensation insurance?
- Pay for your payroll taxes?
- Pay unemployment taxes in case you lose your job?
If the answer to these questions is “no”, you are probably misclassified as an independent contractor. The US Department of Labor is targeting home care agencies that misclassify their caregivers as independent contractors. Agencies that are caught could be subject to heavy fines and penalties as well as years of unpaid overtime. In Maryland, the Department of Labor and Department of Health and the Attorney General has said that misclassifying caregivers as independent contractors is illegal. Click here to read more.
